Creator Terms of Service + Privacy Policy

Legal Entity: Offline Media, Inc. (“Offline,” “we,” “us,” or “our”)
1) Program Description (SMS/MMS)
By opting in, you agree to receive informational messages and alerts related to your account and use of Offline’s creator app (e.g., account notifications, feature updates, project/activity alerts, and service-related reminders). Message frequency varies. Message & data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt-Out: Text STOP to end. After you send STOP, we’ll confirm your opt-out by text and you will no longer receive messages.

Requirements: You must be the account holder or have permission to use the phone number you provide and be at least 18 (or the age of majority in your jurisdiction).
2) Consent & Records
You provide express consent to receive messages when you check the consent box and submit your phone number on our site/app (or otherwise explicitly opt in). We maintain reasonable records of opt-ins and opt-outs to demonstrate compliance. Consent is not a condition of purchase.
3) Account & Eligibility
You are responsible for keeping your account credentials confidential and for activity under your account. You agree to provide accurate information and to use the service only for lawful purposes.
4) Acceptable Use
You will not use the service to send spam, unlawful content, or infringe others’ rights. We may suspend or terminate access for violations, suspected fraud, or abuse.
5) Privacy Policy
5.1 Information We Collect
We collect the minimum information needed to run the creator app and messaging program, such as:
Account & Contact Info: name, email, phone number you provide.
App Content & Usage: creator profile details you submit, settings, and basic usage logs.
Device/Technical Data: IP address, device type, and diagnostics needed to keep the service running.
Messaging Events: opt-in/opt-out status, delivery confirmations, and related compliance metadata.
5.2 How We Use Information
We use information to:
Provide, maintain, and improve the app and messaging program;
Send the informational messages you asked to receive (see Section 1);
Authenticate, secure, debug, and prevent abuse/fraud;
Comply with law and enforce these Terms.
5.3 Sharing & Disclosure
No Third-Party Marketing: We do not sell personal information and do not share end-user information with third parties or affiliates for marketing or promotional purposes.
Service Providers Only: We may share limited information with subcontractors/service providers (e.g., messaging carriers, hosting, analytics strictly for service operations) solely to perform services on our behalf and in accordance with our instructions.
Legal/Compliance: We may disclose information if required by law or to protect our users, our platform, or others.
5.4 Data Retention & Deletion
We keep personal information only as long as necessary to operate the service and meet legal/compliance obligations.
Account Deletion: You can delete your account anytime from within the app or by emailing support@letsgetoffline.com. When you delete your account, we delete associated personal information from active systems and instruct our service providers to do the same, subject to limited retention required for legal, security, or compliance reasons (e.g., opt-out logs or fraud prevention records). We do not keep your information for marketing.
Opt-Out Logs: We may retain minimal records of opt-in/opt-out status and messaging events as required for A2P/TCPA/CTIA compliance.
5.5 Your Choices & Rights
Opt-Out of Messages: Text STOP to end; HELP for help.
Access/Correction/Deletion: Email support@letsgetoffline.com to request access, correction, or deletion. We will verify and respond consistent with applicable law (including CCPA/GDPR where applicable).
5.6 Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method is 100% secure.
5.7 International Users
If you access the service from outside the U.S., you consent to processing in the U.S. (or where our providers operate).
6) Intellectual Property
The app and all related content are owned by Offline or its licensors. You may not copy, modify, or reverse engineer except as allowed by law.
7) Disclaimers
The service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free service or delivery of messages.
8) Limitation of Liability
To the fullest extent permitted by law, Offline and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for claims relating to the service will not exceed the greater of $100 or the amounts you paid to us in the 12 months before the claim.
9) Changes
We may update these Terms/Policy from time to time. If we make material changes, we’ll notify you (e.g., by updating the “Effective Date,” in-app notice, or email). Your continued use after changes means you accept the updated Terms/Policy.
